The process begins with your Original Marriage Certificate. Once you meet the legal requirements for divorce, either spouse can start proceedings by attending their local Circuit Court office and submitting the following documents:
Family Law Civil Bill.
This is the key document, providing the court with a full outline of your case.
Affidavit of Means.
This document sets out a clear picture of your present financial situation. Most courts across Ireland will request it, even where no financial disagreement exists between the spouses.
DIy Divorce
Affidavit of Welfare.
This document records the existing arrangements for the care and upbringing of your children. It is only required in cases where there are children of the marriage.
Once the necessary paperwork is brought to the Circuit Court Office, the proceedings will be formally “issued.” This marks the official start of the divorce process.
After this, the court papers must be served on your spouse within specific time limits and in the correct manner. Should your spouse wish to contest the case, they will need to file additional documents within the required timeframes.
If your spouse chooses not to oppose the application and/or gives their consent, you may then request a hearing date for your divorce.
All divorce hearings take place in camera, meaning they are held privately. Only court staff, you, your spouse, and any legal representatives may be present.

Affidavit of Welfare.
This document outlines the current arrangement regarding the care of your children. This document is only necessary where there are children of the marriage. On attending the Circuit Court Office with the above documents the Court office will “issue” the proceedings. (This is the start of your divorce proceedings) The Court documents must be served on your spouse within certain time frames and in a certain manner. If your spouse wishes to defend the case, he/she must file other documents within particular timeframes. If your spouse does not wish to defend your case and/or is consenting to it you can apply to Court for a date for hearing of your application for Divorce. The Court case will be “in camera” ie, in private apart from Court staff, yourself, your spouse and any legal representatives.
